Kohler Mira, the shower company owned by the US giant Kohler Company, has reported an out-of-court settlement in a design violation action versus Triton and its Inscription collection.
The situation, associated with feasible resemblances with Mira’s Azora ( described) as well as Galena lines, was settled in Mira’s favour and today requires Triton to withdraw all variants of the products, both proprietary or own-branded for retailers, by the end of March 2011. Triton is also required to pay Mira’s legal costs.
Dave Hill, Mira managing director, said: “Each year, Mira Showers invests significantly in intellectual property and new product development. As industry leader in innovation, we can’t and will not allow our investments to be misappropriated through infringement.
“Customers choose our product specifically because of our technical expertise, product innovation and specification support, which over many years has made us a dependable brand. Consuquently, it shouldn’t be underestimated as to how aggressively we will aim to enforce our intellectual property rights in the markets by which we operate.”
